The California Court of Appeal has issued a temporary stay after McGrath Kavinoky LLP challenged a trial court order requiring women suing former Cedars-Sinai OB/GYN Dr. Barry J. Brock to disclose confidential medical records to the hospital. The appellate court will now review whether the lower court correctly applied the law before deciding whether the order should remain in effect.
Hundreds of women have accused Brock of sexually abusing and exploiting patients over more than four decades while practicing at Cedars-Sinai. Brock has denied the allegations and surrendered his California medical license in 2025. The lawsuits also allege Cedars-Sinai received complaints about Brock for years but allowed him to continue treating patients.
McGrath Kavinoky LLP argues that requiring survivors to provide medical records unrelated to the allegations violates their privacy and could discourage victims from seeking justice. The firm is the only one among the many representing Brock plaintiffs to petition the California Court of Appeal over the discovery order.
Jennifer McGrath said survivors should not have to surrender extensive personal medical histories to the institution they accuse of failing to protect them. Darren Kavinoky added that the appellate court's stay signals the privacy concerns raised by the petition warrant careful judicial review. The stay is temporary and does not determine the merits of the underlying case.
