National Alliance to End Sexual Violence Joins McGrath Kavinoky LLP in Court Appeal Fight to Protect Survivor Privacy

The National Alliance to End Sexual Violence (NAESV) has joined McGrath Kavinoky LLP in asking the California Court of Appeal to protect the confidential medical records of women pursuing civil claims against former Cedars-Sinai OB/GYN Dr. Barry J. Brock. NAESV has applied to participate in an amicus brief supporting survivors who are challenging a trial court order that would require broad disclosure of private medical records unrelated to the allegations in the lawsuits.

NAESV, a national nonprofit representing more than 1,000 rape crisis centers and over 50 sexual assault coalitions, argues that forcing survivors to disclose sensitive medical histories as a condition of pursuing civil claims could discourage victims from seeking justice. The organization warns that allowing such discovery would undermine longstanding public policy designed to support survivors and could create a precedent affecting future sexual abuse litigation.

McGrath Kavinoky LLP initiated the legal challenge by filing a Petition for Writ of Mandate after the trial court ordered production of the records. The appeal concerns lawsuits filed by hundreds of women who allege Dr. Barry Brock sexually abused them during medical examinations over several decades. Brock surrendered his California medical license in 2025 and denies the allegations.

According to McGrath Kavinoky LLP, the case presents significant questions about balancing civil discovery with patient privacy. The California Court of Appeal is currently considering whether the challenged order should remain in effect.
